The program will be broken down into the following segments:
I. “Why It Is Important--The Overview and the Psychology of Developing the Damages Case.” Ric Gass and Alan Campo will lead this discussion of why trial lawyers may need to change they way they think about trying damages.
II. “How To Do It—Strategies For Preparing and Arguing Various Types of Damages.” This segment will involve a discussion and demonstration of ways to handle damages in the contexts of different cases.
A. Personal Injury Damages—lead by Jack Trigg, this segment will focus on strategies for dealing with cases where the primary claim involves personal injuries—whether catastrophic injuries or not.
B. Mental Damages—lead by Liz Leedom, this segment will focus on strategies for dealing with cases where the primary claim involves emotional or mental anguish, fear, grief and pain/suffering.
C. Insurance Bad Faith Damages—lead by Doug Houser, this segment will focus on strategies for dealing with bad faith and similar cases.
D. Commercial/Contract Damages—lead by Lori Iwan, this segment will focus on strategies for dealing with breach of contract or similar claims of commercial damages.
E. Anger/Punitive Damages—lead by Wayne Mason, this segment will focus on strategies of minimizing the jury anger that can drive up compensatory and punitive damages.
III. “10 Questions/30 Minutes”—this will be an “on the clock” discussion by faculty members and attendees of key strategic takeaways for the 10 most pressing questions on how to deal with damages.
